Zoning Board of Appeals

April 12, 2016

Present:  Dan Welker, John Ceresoli, Gene Dayton, Brian O’Connor, Paul Adams

Chairman Welker called the regular meeting to order at 7:05 p.m. 

The Wilcox variance public hearing was delayed awaiting the applicant to arrive.



The Board members reviewed the minutes of March 8, 2016.  Upon the motion made by Brian O’Connor, seconded by Gene Dayton, minutes of March 8, 2016 approved as written.  All members present voting in favor.


Old Business

Congratulations to Paul Adams with the extension of his term of office for five years!


Don Clark, Pete & Rena Owens- 317 Genesee Street

Mr. Clark and Mr. & Mrs. Owens appeared before the Board this evening to discuss their request for variance for property they own at 317 Genesee Street.  They are looking to subdivide a two-bedroom second floor unit at the above address and convert it to two 1-bedroom units.  The reason for the variance is that according to the Village Code each unit requires two parking spaces.  They currently do not have enough parking spaces for the units they have.  They would need 8 off street parking spaces for the proposed four units.  They would have five if they use a space that is located in front of the house which is in question that would hold perhaps two or three vehicles.   The question is it their space, it is currently paved and really needs to be repaired.  The request is not to increase the number of bedrooms, but the number of units by one.  They stated they would put in the lease agreement that the 1-bedroom units would only be allowed one vehicle per unit, not two.  The Board discussed the information presented.  The Board will schedule a public hearing for May 10, 2016 at 7 p.m. for the Clark-Owens variance request.  The information from the request should be sent to the Village Planning Board and the Madison County Planning Board.    The Secretary is requested to contact the applicants and remind them that they need to notify the neighbors of the hearing and a sketch of the proposed parking for the Planning Board(s) to review. 


The Board suspended the regular Business meeting and opened the public hearing at 7:15 p.m. 


Wilcox – Variance Request - 173 W Genesee Street

Chairman Welker called the public hearing to order at 7:15 p.m.  He asked Mr. Wilcox to explain the reason for his variance request.  Mr. Wilcox explained that his plan is to build a new garage 32 x 40 with an 18ft high roof line.  This height exceeds the height allowed in the Village Code.  He plans to remove the existing garage structure and build the new building in approximately the same location.  He will have a 10’ side yard which meets Code.  The new building will be high enough for him to put a lift in it so he can work on his personal vehicles.  It will have architectural shingles and vinyl windows and will look very nice.  It will have a single door on the front 18 ft. in width and an 8ft door on the back for access for lawn mowers, etc.  There will be one man door on the front of the structure as well.  He stated that this building will be about 2 ft. taller than the existing garage.  The reasons for the height are to have sufficient pitch for snow load and to allow him to put a lift in the building.   Chairman Welker asked if the Board had any questions.  No one did.  Mrs. Keville from the audience asked about the height of the building and the setback.  Her concern is that her family owns the vacant lot next door to Mr. Wilcox’s property and doesn’t want there to be an issue.  Mr. Wilcox explained the building measurements to her.   She stated she was glad that the new building was set back further on the side than the existing building.    Chairman Welker read Madison County Planning Boards’ recommendation, which they are leaving to Local Board determination and they also recommended that an actual building height be obtained, which Mr. Wilcox has given.    The Secretary commented that Mr. Wilcox had provided signatures of the two of the neighbors, Curtis Tobin, Sr. and Noel Newton who were aware of the public hearing and had no comment.  Chairman Welker asked again if anyone had anything to say for or against the proposed variance request.  No one spoke.  The public hearing was closed.


Chairman Welker called the regular business meeting back to order at 7:25 p.m.


New Business


Wilcox Variance request

The Board members discussed the information presented this evening by Mr. Wilcox for his request to build a garage that exceeds the height requirement set forth in the Village Code for 173 W Genesee Street.  Upon the motion made by Gene Dayton, seconded by Brian O’Connor, the Board approves the variance request for Keith Wilcox to construct a garage with an overall height of 18 ft. which exceeds the height set forth in the Code.   The building is consistent with what is around the immediate area and will not interrupt the site distance as it sits back enough on the lot.  The Board also determines that there is a negative declaration for SEQR.
