Zoning Board of Appeals

November 20, 2017


Present:  Dan Welker, Gene Dayton, Brian O’Connor, Jason Tardio, Counsel Bell, Jordan, Rick Bartlett, Mrs. Doss

Chairman Welker called the public hearing for Burger King area variance request for signage to order at 7:04 p.m.    The Chairman asked Rick Bartlett to explain the Burger King signage request for 520 Genesee Street.  Mr. Bartlett stated that with the renovations at Burger King, he is looking to change the existing free standing sign from a square design to a round design with a smaller dimension than what currently exists.  He is also requested a smaller reader board with a dimension of 3 x5.  Total for the free-standing signage is 43 square feet, the Code allows for 32 square feet.  He is also asking for permission to place an attached sign on the parking lot side of the building instead of the back of the building (which faces McDonnell Street) which is allowed under the Code.  The proposed sign would be round and 4 foot.  The lighting for the Burger King logo signs will be interior lit with LED fixtures.  The reader board would be regular lighting, but at some point in the future could be converted to LED.    The County has taken no position on the signage, left the decision for local determination.  The signage is being changed as part of the major renovation of the building currently underway.  Notices of the hearing for adjacent/surrounding properties were mailed out.  There was no one from the public in the audience that spoke for or against the proposal.  Chairman Welker asked if the Board had any questions.  No questions from the Board.  The public hearing was closed at 7:15 p.m. 


The Chairman called the regular meeting to order at 7:15 p.m.



The Board members reviewed the minutes of October 16, 2017.  Upon the motion made by Brian O’Connor, seconded by Jason Tardio, minutes of October 16, 2017 approved as written.  All members present voting in favor.


New Business


Burger King Area Variance request – 520 Genesee Street

The Board members discussed the request for variance for signage at the Burger King restaurant at 520 Genesee Street.  Upon the motion made by Gene Dayton, seconded by Brian O’Connor the Board approves the request for area variance and revised location of second attached sign as set forth in the design sheet prepared by Entera dated October 12, 2017.  The free-standing sign will consist of a round Burger King logo sign and a 3 x 5 reader board sign that total 43 square feet in area that exceeds the 32 square feet allowed for in the Code, and the attached sign that is allowed for the rear of the building (McDonnell Street side) will be allowed to be moved to the parking lot side (Pizza Hut side) of the building and will be a 4 ft. round Burger King logo sign.  There will be no rear sign as this allowed sign is being requested to be moved to the side by the applicant.  The Board discussed the motion.  Mr. Bartlett stated that the proposed signage is less than what currently exists at the facility.   The Burger King logo signs will have LED lighting, but the reader board will be standard lighting at this time, if this changes the owner will advise the Code office.  The Board noted there was no public opposition to the requested variances, the variance is the minimum to grant relief, and the signs are not offensive and will not change the character of the area.  The Board also determines this to be a negative declaration for purposes of SEQR as part of the coordinated review with the Planning Board.

The Chairman reminded everyone to call in reservations if they plan to attend the Village Dinner on the 8th.  Please call by the 4th.


Land Use Activity Update

There is a draft local law for the land use activity that was discussed at the last meeting.

The Clerk will send the draft law to the Board members for their review.


With no further business, meeting adjourned at 7:40 p.m.
