Zoning Board of Appeals

Chairman Welker called the public hearing for Banke at 7:02 p.m.
Banke – 333 S Webber Drive Public Hearing
Mr. Banke appeared before the Board this evening to request a variance on the side yard lot line at his property due to the replacement of an existing shed which was 8 x8 with a new shed that is 8 x 12 and is located on a gravel base. He would maintain the same side yard setback of 5 ft. 4”. The previous shed was on the property when he purchased the home. He stated he was placing the new shed in the same location. If he moves the shed any closer toward his house, he would not have access to his backyard where he currently does store his boat and trailer. There is just enough room to get the trailer between the shed and the house. He showed the Board photos of the old shed and the new shed. He provided a copy of the survey, which did show the previous shed with the 5’4” side yard setback. The hardship is that there is really no other location the shed can be placed that would still allow access to the back yard of the property. There are trees on the side yard lot line which prevent him from accessing his backyard on that side. The Secretary advised that notices were sent out to the neighbors in regard to the public hearing. Mr. Banke asked about his house, which he noted was 8’4” off the side yard. The Code Officer noted that most of the homes in this area were built before the Zoning Codes were in place. If something were to happen to the home, the home could be rebuilt on the same footprint if done so within a year. Chairman Welker if the Board had any further questions. No one had any questions. No one from the public appeared at the hearing. Upon the motion made by John Ceresoli, seconded by Jason Tardio, public hearing closed at 7:14 p.m. All members present voting in favor.
Chairman Welker called the regular meeting to order at 7:14 p.m.
The Board members reviewed the minutes of January 15, 2018. Upon the motion made by Paul Adams, seconded by John Ceresoli, minutes of January 15, 2018 approved as written. All members present voting in favor.
Banke Variance Request
The Board members discussed the information presented this evening for the variance request for Banke’s at 333 S Webber Drive to locate a shed closer to the side yard lot line than is allowed in the Village Code. Upon the motion made by Chairman Welker the Board approves the placement of the new 8’ x 12’ shed located 5’4” from the side yard property line, seconded by John Ceresoli who added language that the shed can’t be moved closer to the house by the owner as it would block access to the back yard, which the resident uses to store his boat and trailer in.

Motion carried. A letter will be sent to the applicant noting the approval of the requested variance. Mr. Banke was advised that he needs to go to the Code Officer for the permit approval process for the new shed.
The Secretary advised that there is training available through the Onondaga County Planning Federation on March 1 if anyone is interested in attending.
The Board discussed the upcoming budget for 2018-19. The Board asked that the budget for Zoning Board be maintained at its’ current level.
The next meeting will be March 19.
